Terms of Service

TL;DR

  • Message me at im@vital.monster or one of my social media with your project details and refs. We'll refine the scope together, agree on the price, payment, and deadline if any. Allow at least one week for replies.
  • Payment is due before I start working on the project, but only after I accept the order (do not pay in advance).
  • I accept payments by bank transfer, or by cash at in-person events.
  • You get up to 4 minor revisions/edits free (artist mistakes excluded).
  • Refunds vary by stage and depend on the amount of work done at the time of cancellation (by you or by me). No refunds for physical goods that are already produced or in production.
  • You can expect your commission to be done within at most 6 months once it is accepted.
  • Commissions are for personal use only. Sharing is allowed if credited. Commercial use requires prior permission and proper licensing.
  • You cannot alter my work without my permission first, nor can you use my work for or with AI.
  • I retain copyright and may use work for promotion or merchandise unless we agree otherwise.

Process

What to expect when commissioning me

  1. First contact: You message me directly (see the Contact section) or via a dedicated form, when available, with the details of your project. Please send me any visual references that you think might be useful (for your characters, accessories, mood boards, etc.).

    Don't hesitate to make bad (or even good) stick figure drawings to convey your idea, they are greatly appreciated and easier to understand than long descriptions !
  2. Defining the project scope: We exchange together to refine your project. During this stage, I will send preliminary drafts or rough sketches to help pin down the specifics of your project, and we will discuss payment (see Payment), deadlines if applicable (see Deadlines section), and any other aspect of the commission.

  3. Confirmation and payment: Once we have agreed on the details and the price, I will ask you to make the full payment (or first installment if you chose that option, see conditions in the Payment section). Once the paymend is received, I will add your project to my queue and notify you once I begin working on it.

    Do not send any payment until your order is accepted and I asked for it!
  4. Progress updates/Edits: You will be prompted to review and approve each step of the creation, from the first sketches to the finished product. The actual steps may vary depending on the nature of the work.
    You may request up to four (4) minor revisions (aka edits) in total during the project; additional or major revisions will be subject to additional fees as defined in the Rates section, that must be paid in full before I proceed with the adjustments.

    Of course, revisions that are necessary because I made a mistake are not counted towards the limit nor are they billed.
  5. Finished product: Once your project is finalized and validated, I will send you the final product using the most appropriate mean (full resolution illustration for digital work, shipping for traditional work/physical goods).

Note that this process serves as a template for the actual process that will be applied to your commission. It might be different based on the specifics of your project. In any case, I value transparency and will do my best to keep you updated with any significant progress.

Rates

How commission prices are calculated

I apply a base rate of 30€/hour for my work. However, please note that this rate is not applied strictly; instead, it is used to calculate commission prices based on a projected estimate of the complexity and time required for your specific order.

I reserve the right to apply different rates at my own discretion if I deem it necessary, especially if the production of your project requires additional costs (for example, for physical merchandise). You will always be notified about it before I start working on your order though.

In practice, this means that the total price of the agreed-upon commission won't change after an invoice has been issued. You don't have to worry about surprise charges appearing out of thin air.

Additionally, any requests for additions or modifications that were not included in the original order will be subject to additional fees at an overtime rate of 50€/hour.

Rush orders may incur additional fees, depending on how short the deadline is (see the Deadlines section), up to 40% extra of the commission price, and are subject to acceptance on my part.


Payment

How payment is handled

I currently accept online payments via bank transfer only, as well as cash payments during in-person events. All prices are quoted in euros (EUR €) unless otherwise specified.

Orders valued at€100 or more are eligible to be paid in installments. The specific conditions, amounts, and timeline for these split payments will discussed on a case-by-case basis and must be agreed upon before I start working on your order.

Refunds are possible under different conditions at different stages of the process. For more details, please refer to the Cancellation/Refunds Policy section.


Deadlines

What timelines you can expect

Depending on the nature and complexity of your commission, my current workload queue, and personal circumstances, it may take up to 6 months to complete your order once it has been accepted.

You may specify a deadline when first contacting me about your commission, or as soon as feasible. I do my best to accommodate your request, keeping in mind that:

  1. I cannot guarantee completion by the given deadline if it is too short, especially if communicated at a later stage (i.e. after I accepted it).
  2. I reserve the right to refuse the commission if I feel I cannot realistically meet your deadline, though I will always give you the option to set a different deadline beforehand.
  3. Rush orders (i.e. orders that require adjustments to my queue/planning to meet your deadline) will incur an additional fee, ranging from 5% to 40% of the commission price.

Rush order fees may be refunded in whole or in part if I cannot meet the agreed-upon deadline due to a fault of my own. A notable exception applies for physical merchandise that ships on time but experiences delays during transit.

Once your commission is accepted, I will keep you updated on progress at significant stages, especially if a deadline has been set and is closing in. You are welcome to ask for updates if you haven't received one in a while; I appreciate your patience and politeness in such inquiries.

Cancellation/Refunds Policy

How cancellations and refunds work

I reserve the right to decline or cancel a commission at any time for any reason. In such cases, you may be refunded based on the work that has already been completed, up to 75% of the original price if I have only just begun work on your order.

You also have the option to cancel your commission at any time; the same rules and refunds policy apply: the refund will depend on the amount of work already done and may not exceed 75% of the original price.

Please note that refunds may take up to 30 days to process.

For physical goods, please be aware that there will be no refunds for merchandise that has already been produced or is currently in production (except for shipping fees that may be reimbursed if the product hasn't been shipped yet). This applies to items lost or damaged during shipping.

Additionally, I may reuse sketches and other works that have been rejected or canceled for future commissions or personal projects.


Your Rights as a Customer

What you can and cannot do with your commission

Commissions are for personal use only.

You may:

  • Post your commission on social media and/or personal blogs.
  • Share it with friends, family, or private circles.
  • Print it for yourself.

When sharing your commission publicly, please ALWAYS include proper credits.

If your commission is intended for commercial or professional use, contact me directly (see the Contact section) for permission beforehand; depending on the specifics of the commission, licensing it for commercial or professional use may incur additional fees.

Additionally:

  • You may NOT modify, crop, watermark, remove the signature from, or otherwise alter the artwork in any way that would result in an identifiably different illustration/product without my prior authorization.
  • You may NOT use any of my work for AI training, or as input for AI models for any purpose.
  • You may NOT use AI to alter my work or create derivative content from it.

AI in this context is meant to be understood as any program that is commonly referred to as Artificial Intelligence, such as LLMs, VLMs, deep learning, machine learning algorithms, etc.


My Rights as an Artist

What I can and cannot do with my work

I retain all copyrights to the commissioned work, including (but not limited to) drafts, sketches, intermediate drawings, works in progress (WIPs), finished artwork, and derivatives (when applicable). This does not include your characters or any original concepts that you or someone else own, and that you entrust me with for the purpose of your project.

I have the right to use the commissioned work and any related piece created in the process of its creation to advertise my activity. This includes posts on social media, my website, portfolios, art books, using the work as examples for future commissions, etc. If necessary, I can temporarily refrain from exercising this right upon request (for example, if the commissioned work is meant as a gift).

I am also allowed to use the commissioned work to create merchandise, prints, and other derivative works for commercial purposes, unless negotiated otherwise. I will always notify you beforehand if this ever happens.

Furthermore, I reserve the right to decline a commission for any reason and without justification.

If I contact you first, please ensure it's from one of my official accounts. When in doubt, don't hesitate to reach out on another platform to confirm the legitimacy of the account. I cannot be held liable for any damages you may sustain due to someone impersonating me.

I speak English 🇬🇧 French 🇫🇷 fluently; please stick to one of those two languages, whichever you are most comfortable with.

I'll do my best to respond to your messages promptly; but be aware that it may take several days for me to get back to you at times. Please allow at least one week for a response before sending a follow-up.

When contacting me for the first time, please introduce yourself and provide a brief explanation on why you are reaching out. I won't answer to vague inquiries or messages unrelated to my work as an artist, and you might get blocked and/or reported if your account seems suspicious (nothing personal, I'm just protecting myself).

I will not tolerate any form of harassment, hateful/harmful/disrespectful behavior, or any other conduct that undermines the dignity of myself or others. I am a person first and foremost, and as such I expect our interactions to be, if not friendly, at least respectful (but I hope they can be friendly).
